Review of the Holidays Act 1910 (South Australia)



The South Australian government has issued an options paper seeking to review South Australia’s public holidays legislation and to modernize existing provisions to reflect contemporary patterns of work.

This arises out of an agreement between Business SA and The Shop, Distributive and Allied Employees Association allowing retail trading to occur on both Christmas Eve and New Year’s Eve. ASIAL has drafted a submission on the impact for the industry of any changes in public holiday determinations in the state.

In essence, ASIAL is opposed to any extension to the current public holiday legislation.


South Australia announces new trading hours


SA Premier Jay Weatherill has announced that proposed new trading hours have been agreed between the Government and Business SA. The proposed changes (expected to be introduced in 2012) will create part public holidays on Christmas Eve and New Year’s eve from 5pm until midnight. The proposed changes will have implications for security operators. ASIAL will be making representations to the government on the proposed changes.View Media Release

SA Security and Investigation Agents Regulations 2011


As at 1 September 2011, the new Security and Investigation Agents Regulations 2011 will commence.

The regulations required an automatic review (legislated requirement) as the 1996 Regulations had been in existence for 14 years. The changes do not reflect reforms outlined in a discussion paper and draft Bill released in April 2011 regarding amendments to the Security and Investigation Agents Act 1995 involving the national COAG initiatives.

The re-making of the regulations involves some renumbering of the provisions and updating of existing references (for example, correcting references to other legislation or organisations). The changes to the regulations have been made to ensure that they will not have any impact on the obligations of security and investigation agents under the law. That is, the re-numbering of sections and updates to references should have no practical impact on the industry.

The new regulations will be renamed as the Security and Investigation Agents Regulations 2011. A copy of the re-made regulations can be found at

OCBA announces changes for business knowledge and experience requirements


The Office of Consumer and Business Affairs has announced changes and clarification for applicants in meeting the business knowledge and experience requirements for a business condition under the Security and Investigation Agents Act 1995. Changes to SA Liquor Licensing Laws


The changes to liquor licensing laws that will take effect from 3 May 2010 will benefit producers and other licensees by reducing costs and red tape, while still promoting responsibility service and consumption of alcohol at licensed premises.
